 SECTION 1 - WHAT DO WE DO WITH YOUR INFORMATION?

When you purchase something from our store, as part of the buying and selling process, we collect the personal information that you give us such as your name, address, and email address.

When you browse our store, we also automatically receive your computer’s internet protocol (IP) address, as well as other device and internet information, like your device ID, browser type, operating system, and the website you visited just before ours. Depending on your state of residence, these types of information may be considered ‘personal information.’ We collect this personal information to learn about your browser and operating system, ensure the integrity and security of our website, and also better tailor the advertising and other promotional content that we may send to you.

With your permission, we may send you emails about our store, new products, and other updates.

We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service. We also share your personal information as needed with a number of third-party providers to help us run and support our business. Please see Section 4, below, for more information.

SECTION 3 – SHOPIFY

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

Your data is stored through Shopify’s data storage, databases, and the general Shopify application. They store your data on a secure server behind a firewall.

Payment

If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.

PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

SECTION 4 - THIRD-PARTY SERVICES

In general, the third-party providers used by us will only collect, use, and disclose your information to the extent necessary to allow them to perform the services they provide to us. We use third parties to provide services like data analytics, hosting and storage services, and web developers, to assist us with website operations and maintenance. We also use third parties to provide services like business communication tools, finance and accounting services, order fulfillment, and other eCommerce services to help us run our business and fulfill transactions requested by you. Finally, we also work with advertising networks and social networks to improve our marketing efforts. 

Please note that certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.

For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.

In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.

Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

SECTION 5 – MARKETING

As described above, we work with advertising networks and social networks to improve our marketing efforts. These advertising and social network third-party providers may collect information about your online activities over time and across different websites.

Some web browsers may transmit signals instructing websites and other online services not to track personal information. Currently, our website does not respond to these browser signals or similar mechanisms. 

SECTION 6 - SECURITY

Although no method of transmission over the Internet or electronic storage is 100% secure,  we take reasonable precautions to make sure your personal information is not inappropriately lost, misused, accessed, disclosed, altered, or destroyed.

We work with Shopify, a PCI-DSS compliant payment processor, to make sure that your credit card information is processed in a secure manner, including the use of encryption and other technologies. 

SECTION 7 – COOKIES AND OTHER TRACKING TECHNOLOGIES

We use cookies and potentially other tracking technologies, like pixels, tags, or web beacons, to support and improve the functionality of our website. We also use these tracking technologies to help us better market our products to you and other consumers.

By using this site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

SECTION 9 - YOUR NEVADA RIGHTS

2019 Nev. L. 211 permits customers of TIMY who are Nevada residents to request that we not sell their personal information. We do not sell personal information as defined by Nevada law. SECTION 10 - SMS MARKETING SERVICES
We may collect your phone number if you sign up to receive our specific SMS marketing service. We use this information to send you text notifications (for your order, including abandoned checkout reminders), text marketing offers, and transactional texts, including requests for reviews from us. We will not share your consent with any other third parties, except for messaging partners, for the purpose of enabling and operating our text messaging program.
As further described below, our website uses cookies to serve a variety of purposes, including keeping track of items you put into your shopping cart and when you have abandoned your checkout. This information is used, in part, to determine when to send cart reminder messages via SMS marketing services.

Do we collect children’s information?
We will never knowingly request personal information from anyone under the age of 13. Our website is not targeted to or intended for use by children. However, if we learn that we have received personal information from a child under the age of 13 without appropriate parental consent, we will delete that information from our database.

Retention

We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make a material change that will apply to information that we have already collected, we will seek your affirmative consent to such a change. 

If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.
